A    About Us

As a Bidder using the services of TimesharesForAuction.com (Auctioneer), it is assumed that you will have read the following Terms and Conditions of this auction site.

Timeshare Resales USA, a Florida Corporation (The Broker) is a licensed Real Estate Brokerage operating under the laws of the state of Florida and specializing in timeshare resales. The Broker  is providing the Bidders the opportunity to submit a bid on interval vacation ownership and will not be held liable for the actions of the Bidders on our site. This includes any of the following:

  • Failure by the Bidder or Seller to complete transaction

  • Accuracy of description of the listing

  • Communication of any kind between The Broker  and the Bidder and/or Seller

  • In today's world of high tech communications, The Broker  can not be held responsible for your inability to access our web site or server during down time.

B    Registration

You must be at least 21 years of age to be registered as a Bidder on The Broker s auction web site. You must provide your actual name, address and telephone number and any other information requested on the Bidder registration form. Providing fraudulent information will preclude you from transacting any purchase on our auction web site.


C    The Auction

The Broker  will start the auctions on Monday and they will end on Sunday. The Broker  has the option to extend the auction time period. All bids received during this period of time will be presented to the Seller by a licensed real estate sales person.  Our unique program of presenting all bids to the Seller, when the reserve price has not been met or exceeded, allows more latitude in putting a buyer and Seller together.


D    Bidding

Before you may bid in our auction program, you must first register online. There is no charge for registration to be a Bidder.

This is a Reserve Price Auction. This means the Seller's lowest price is protected.

Our unique auction program is a closed bid program where all bids at the end of the auction period will be presented to the Seller by a licensed real estate sales person. If the reserve price has not been met, there is still an opportunity to create a sale. Remember.. most people are negotiable. Before bidding on a property, you should make sure you know what the property is and if you want the property. Make sure you understand the extra costs of the property, such as maintenance fees, taxes and etc.

By placing a bid, you are placing a legally binding offer to purchase the property at any price up to your maximum bid amount. Failure to complete the transaction is a breach of the agreement and The Broker  may suspend or terminate your user account.

If you bid on multiple properties, you are placing a legally binding offer to purchase each and every property you bid on.


E    Ownership Transfer

The Broker  will provide the sales contract work for both buyer and Seller. A licensed, bonded title company will provide all the necessary title work on deeded property or any paperwork requiring the transfer of membership.


 F   Escrow Deposit

Funds will be held in The Broker 's Escrow account in Orlando, Florida. An escrow deposit is required from the buyer in order to proceed with the sale.


G     Closing Costs

Closing costs vary, depending on the location of the resort. These costs are paid by the buyer for all work provided by the title company.


H     Inspection

Buyer acknowledges that he/she has made their own investigation as to the Property and has inspected the physical condition of the property prior to auction.     


I     Warranty Of Sale

Seller shall execute any and all documents necessary to transfer title of the property  to the buyer. Seller shall convey marketable title to the property subject to all existing covenants, conditions, easements, restrictions, reservations, right of way and any zoning of record. Seller shall pay any and all liens.


J   Maintenance Fees

All Maintenance fees are by the year unless otherwise stated. Maintenance fees vary from year to year. In addition to maintenance fees some resorts may charge additional fees to cover taxes and variable assessments. Maintenance fees, assessments and taxes will be based on usage.


K   Contract

After the bid is presented and accepted by the Seller, the parties will execute the sales Contract.


L   Disclaimer

Neither Auctioneer nor Broker  will make any kind of representations or warranties, whether expressed or implied, as to the condition of the property, Its merchantability, or fitness for buyer's intended use. The property is sold on an as-is where-is basis.


M   Choice of Law

The agreement and the performance hereunder and all suits and special proceedings hereunder shall be construed in accordance with the laws of the State of Florida. All actions under this agreement shall be taken in a court of competent jurisdiction in Orange County, Florida and no party shall advance a position that such forum is improper and inconvenient.
